Any delay in the performance of obligations under the Warranty or this Service Agreement (other than payment of fees due) by either party will not be considered a breach if such delay is caused by a labor dispute, lack of materials, fire, earthquake, a flood or any other event beyond the control of that party, provided that that party makes reasonable efforts to: inform the other party of the circumstances causing the delay and resume performance.
